REACH Process

خطوات "الريتــش"

REACH created the European Chemicals Agency (ECHA) which coordinates and implements the REACH process.

Under the REACH process, all manufacturers and importers of chemicals must identify and manage the risks linked to their chemicals.

For substances produced or imported in quantities of 1 tonne or more per year per company, manufacturers need to demonstrate that they have appropriately done so by means of a registration dossier submitted to the ECHA which will then check the compliance with the Regualtion.

REACH Processes

Pre-registration

Manufacturers which have products already on the European market and importers have to pre-register substances that are already on the EU market, if they want to benefit from transitional arrangements that allow registering them at a later stage. Pre-registration also has the advantage, that registrants can share data with other registrants and thereby can avoid carrying out redundant tests. The pre-registration period is limited from 1 June 2008 to 1 December 2008.

Registration

Under REACH manufacturers and importers of chemical substances (≥1 tonne/year) have to obtain information on the physicochemical, health and environmental properties of their substances and use it to determine how these substances can be used safely. Each manufacturer and importer must submit a registration dossier documenting the data and assessments to the European Chemicals Agency (ECHA).

Only Representative

For exporters outside of the EU, an “only representative” has to be appointed.

According to Article 8 of the REACH Regulation, a natural or legal person established outside the Community who manufactures a substance on its own or in preparations, formulates a preparation or produces an articles imported into the Community may by mutual agreement appoint a natural or legal person established in the Community to fulfil, as his only representative, the obligations on importers regarding the registration of substances. The only representative shall also comply with all other obligations of importers under REACH.

GEDcom AG can act as the “only representative” for non EU manufacturers which are exporting their substances to the EU.

Evaluation

The ECHA will evaluate the submitted dossiers to check whether they comply with the requirements of the regulation. It will also coordinate substance evaluation.

Authorisation

Authorisation will be required for the prioritised substances of very high concern (SVHC) that are included in Annex XIV.

It has to be investigated by the applicants whether it is possible to substitute theses substances with safer alternatives or technologies, and prepare substitution plans, if appropriate.

Restriction

The EU can restrict or inhibit the manufacturing or marketing of certain substances. It can also set the conditions under which it can be produced or brought to market.

Communication in the supply chain

Suppliers of substances must inform the downstream users of the substances they produce on information on the health, safety and environmental properties and safe use of their chemicals. This can be down via a Safety Data Sheet or other means. These downstream users may only use these dangerous chemicals if they have a appropriate risk management measures in place.

تقوم الوكالة الاوروبيـة للكيماويات(ECHA) بتنسيق وتطبيق خطوات "الريتــش".

ويندرج تحت تطبيق خطوات "الريتــش" أن يقوم كافة مصنعى ومستوردى الكيماويات بتعريف وادارة كـافة المخاطـرالمتصلة بتلك الكيماويات.

بالنسبـة للمواد التى تنتـج أو تستورد لكمية ( 1) طن أو اكثرفى السنة لكل شركة، فأنه ينبغى على مصنعى تلك الكيماويات أن يقوموا باثبات ذلك عن طريق تقديم "ملف تسجيل" الى ECHA والتى سوف تقـوم بالتدقيق فى اتباع كافة التعليمات.

خطوات "الريتــش"

أجراءات ما قبل التسجيــل

على المصنعييـن والمستوردين الذيـن تتواجـد منتجاتهم فى الاسواق الاوروبيـة أن يقوموا بالانتهاء مـن أجراءات ما قبل التسجيــل لتلك المواد، وذلك رغبـة منهـم فى الاستفادة من الاجراءات الانتقالية التى تتيح لهم التسجيــل فى مرحلة تاليـة. ومن مزايا الانتهاء مـن أجراءات ما قبل التسجيــل ان المسجليـن يستطيعون مشاركة البيانات فيما بينهم لتجنب القيام بالاختبارات المتكررة. وتنحصـر أجراءات ما قبل التسجيــل فى الفترة من 1 يونيو 2008 الى 1 ديسمبـر 2008 .

التسجيــل

تحـت تعليمات "الريتــش" فان مصنعى ومستوردى الكيماويات للكميات أكثـر من (1) طـن فى السنـة لابد لهم من الحصـول على المعلومات الخاصـة بالخواص الطبٍٍيعيـة\ الكيماوية، الصحيـة والبئية لتلك المواد وان يقوموا باستخدام تلك المعلومات لتحـديـد الاستخدامات الامنة. ٍويجـب على كل مصنع و مستورد ان يقـوم بتقديم "ملف تسجيل" الى European Chemicals Agency - ECHA يتضمن تلك البيانات.

ممـثل وحـيد

لابـد للمصدريـن مـن خارج الاتحاد الاوروبى من تعييـن ممـثل وحيـد.

فطبقـا للفقـرة رقم (8) من لوائح "الريتــش"، فأن الشخص الطبيعى اوالكيان القانونى والمشهـر خارج نطاق الاتحاد الاوروبى والذى يقوم بتصنيع المادة فى حالتها الاولية، او فى اعداد تركيبة، او انتاج منتج يتـم أستيراده الى داخـل الاتحاد الاوروبى له الحق من خلال توقيع اتفاقية ان يقوم بتعييـن شخص طبيعى اوكيان قانونى كممثـل وحيد عنه فى القيام باجراءت تسجيل تلك المواد. وعلى الممثل الوحيد ان يتماشى مع كافة الاعتبارات الخاصة بالمستوردين تحت لوائح "الريتش".

GEDcom AG تقوم بدور الممثـل الوحيد للمصنعييـن من غير دول الاتحاد الاوروبى والذين يقومون بتصديـرالمواد الى الاتحاد الاوروبى.

التقييـم

سوف تقوم ECHA بتقييم الملفات المقدمة اليها للتأكد من مطابقتها الى متطلبات اللوائح. وسوف تقوم بتنسيـق تقييـم المادة المطلوب تسجيلهـا.

الاعتــماد

يكون الاعتماد مطلوبا حسب اولويات المواد ذات الدرجة العالية من الاهتمام (SVHC) وذلك حسب ما جاء فى الملحـق XIV.

يقوم المتقدمييـن بالتحقـق من امكانية استبدال المواد ببدائل أخـرى أكثر امان اوتكنولوجيات بديلة، ووضع الخطط البديلة كلما كان ذلك متاح.

الحظـر

للاتحاد الاوروبى ان يحـظر أو يمنع تصنيع او تسويق مواد بعينها. كما انه يستطيع وضـع الشروط الخاصة بتصنعيها اوادخالها الى الاسواق الاوروبية.

الاتصال عبـرقنوات التوريـد

على مصنعى وموردى المواد أخطار المستخدميين النهائيين لتلك المواد بكافة المعلومات المتعلقـة بالصحة، الامان والخواص البيئية والاستخدام الامن لتلك الكيماويات. وهذا يمكن تحقيقه من خلال "بيانات الامان" Safety Data Sheet او وسائل أخرى. ويمكن لمستخدمى تلك المواد الخطـرة من استخدامها فقط فى حالة تواجـد وتطبيق نظام أدارة مخاطـر.
